What to Look for When Hiring a Process Server

Look for Credentials

Process Servers in New York State (outside the five boroughs of New York City) do not require special licensing.

Process Servers who display the NAPPS and NYSPPSA logos have voluntarily undergone a criminal background check before being accepted, and agree to adhere to industry best practices & professional standards of conduct.

Crimes of moral turpitude are those which reflect on a person's character. When a court is considering whether to accept an affidavit of service, it will consider the credibility of the process server. If the process server has a conviction for a crime of moral turpitude, the court may be more likely to find that the affidavit is not credible.

In general, courts in New York State have the discretion to reject affidavits if they believe that the process server is not credible or that the affidavit is not reliable. If a court rejects an affidavit, the party who submitted the affidavit may be able to appeal the decision.

Each case is different, and the court will consider all of the relevant factors in deciding whether to reject an affidavit.

Once you've chosen a process server, make sure to get everything in writing, including the terms of the service, the fees, and the guarantees. This will protect you in case there are any problems down the road.
